4.2 Maximum Aggregate Liability

Our total aggregate liability for all claims arising from or related to these Terms and Conditions or your use of our services shall not exceed the total amount you have paid to Revenue Logic for services during the twelve-month period immediately preceding the event giving rise to the claim. If you have not paid any fees, our liability shall be limited to one hundred United States Dollars ($100).

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet failures, or other force majeure events.

4.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations may not apply to you, and our liability shall be limited to the maximum extent permitted by applicable law.

5. Legal Information and Dispute Resolution

5.1 Governing Law

Before initiating any legal proceedings, you agree to first attempt to resolve any disputes informally by contacting us with a detailed description of the dispute. We will attempt to resolve the matter through good faith negotiation within thirty days of receiving your notice.

5.4 Arbitration Agreement

If informal resolution fails, any remaining disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Dallas, Texas. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

5.5 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in any class action lawsuit or class-wide arbitration.

5.6 Limitation on Time to File Claims

Any cause of action or claim you may have arising from these Terms and Conditions must be commenced within one year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.
